Program will provide Agents and Brokers with information on The Employee Retirement Income Security (ERISA) affecting group health benefit offerings and ACA Compliance Requirements as it pertains to the Benefit Agents’ role working with their employer clients. 

Often, employers are uncertain about their compliance and ACA reporting responsibilities as well as uncertain about potential penalties for noncompliance. Employers can be fined and can incur significant fines and/or IRS penalties for failing to meet their obligations established under ERISA regulatory requirements and 4980h (a) & (b) ACA Health Benefit offerings to their employees.  

This presentation includes a review of ERISA Health Plan Document Requirements and IRS fines and penalties associated with ACA noncompliance.  Mr. Aitchison will share information on IRS 226J, 5698 penalty notice letters issued by the IRS and his experience working through over $25 million in proposed employer IRS penalties.  

Employer participants will be able to use information gained during the presentation to assess their preparedness as it relates to ERISA and ACA Employer requirements.    



About our speaker

Joe Aitchison, SPHR, SHRM-SCP, CHRS – Senior Vice President of Business Strategies and one of BASIC’s top compliance specialists working with clients nationally.  BASIC is a HR Service Company providing employer solution in the areas of human resources and benefit administration.  Services include payroll, unemployment, COBRA, FLEX, FMLA, ERISA Compliance, ACA Reporting and HR outsource services.

Mr. Aitchison holds a lifetime certification as a Senior Professional in Human Resources and obtained certification by the Society of Human Resources as a Senior Certified Professional.  Additionally, Mr. Aitchison maintains professional certification as a Healthcare Reform Specialist.    He has thirty years of human resource, business management and consulting experience working with international automotive manufacturing, commercial manufacturing, warehouse and distribution, transportation, retail, gaming & hospitality, food processing, health care, legal, financial, engineering & scientific professional services, public sector and not for profit organizations. Positions held include: CEO/President, senior executive, operations management and company director. Mr. Aitchison serves as a board member on several profit and not for profit boards and is currently Board Chair and Executive Director of HR ComTrak, a Human Resource Compliance, Training and Knowledge Center.
